A Guideline explains how the Commission expects a requirement to be met in practice. It sets mandatory minimums (“must”) alongside recommended practice (“should”) and options (“may”). The “must” provisions are binding like any other Commission Policy. The “should” provisions describe the Commission’s expectation: a Licensee that departs from them must be able to explain why its approach achieves the same outcome.
Use a Guideline when outcomes matter more than a single prescribed method, for example where Licensees’ products and markets differ, and the Commission wants to set minimums while leaving room for judgment.
Current example: the Terms and Conditions Guideline. The Application Guidelines under Regulation 6.2 are a procedural Guideline for Applicants.
